- ilnd;;1:15-cr-00349_de3 RegisterActionDescriptionText "ORDER as to Max Julian Wright: Initial appearance proceedings held on 6/12/15. Defendant Max Julian Wright appeared in response to his arrest on 6/11/15. Defendant was informed of his rights. Piyush Chandra from the Federal Defender Program is assigned as counsel for Defendant. Defendant was informed of his right to a preliminary hearing. Defendant reserves his right to a preliminary hearing. Removal proceedings held. Defendant waived an identity hearing. The Court finds that Defendant Max Julian Wright is the person named in the arrest warrant. The Government orally moved to detain Defendant on the ground that Defendant poses a serious risk of flight and presents a danger to the community. The Government's oral motion to have Defendant removed in custody is granted. Defendant does not contest detention at this time without prejudice to his ability to raise the issue of detention in the charging district. For these reasons, the Government's unopposed oral motion to detain Defendant is granted. Because the motion is unopposed, the Court makes no finding as to serious risk of flight, danger to the community or any other statutory factor that is relevant to the issue of release or detention under 18 U.S.C. §3142. The Court's order is without prejudice to Defendant contesting detention and raising the issue of release at a later time if he so chooses. Accordingly, Defendant is ordered removed to the Northern District of Iowa in the custody of the U.S. Marshal forthwith. As provided by 18 U.S.C. § 3142(f), Defendant is remanded to the custody of the U.S. Marshal and shall remain in custody until further order of the Court. It is ordered that Defendant shall remain confined in the Metropolitan Correction Center or an alternative facility designated by the U.S. Marshal, pending his removal to the charging district, but held separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. It is further ordered that Defendant shall be afforded reasonable opportunity for private consultation with his counsel while in custody. (Terminated defendant Max Julian Wright). Signed by the Honorable Jeffrey T. Gilbert on 6/12/15. (las, ) (Entered: 06/16/2015)" @default.
