- ilnd;;1:15-cr-00350_de42 RegisterActionDescriptionText "ORDER as to Frederick Lewis: Arraignment hearing held on 8/7/15. Initial appearance held on 8/7/15. Defendant appeared in response to his arrest on 8/6/15. Defendant was informed of his rights. The Court finds the Defendant is unable to afford counsel. Gerald J. Collins, of the Federal Defender Panel, is assigned to represent Defendant. Defendant waived a formal reading of the Indictment and entered a plea of not guilty to each charge and all counts of the Indictment in which he is named. The Court sets the following schedule: Rule 16.1(a) conference shall be conducted on or before 8/14/15. Pretrial motions shall be filed on or before 8/28/15. Responses shall be filed on or before 9/11/15. Status hearing before Judge Tharp is set for 9/22/15 at 9:15 a.m. On the Government's oral motion and Defendant not objecting, the Court finds that the time until the next status hearing before the District Judge shall be excluded in the interests of justice pursuant to 18 USC 3161(h)(7)(B)(iv) in order to allow reasonable time for effective preparation. The Government orally moved to detain the Defendant as a risk of flight and danger to the community. In accordance with 18 U.S.C. § 3142(f)(2), for good cause shown and by agreement of the parties, a detention hearing before Magistrate Judge Gilbert is set for 8/13/15 at 1:30 p.m. in courtroom 1386. As provided by 18 U.S.C. § 3142(f)(2), Defendant is remanded to the custody of the U.S. Marshal and shall remain in custody until further order of the Court. It is ordered that Defendant shall remain confined in the Metropolitan Correction Center or an alternative facility designated by the U.S. Marshal, but held separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. It is further ordered that Defendant shall be afforded reasonable opportunity for private consultation with his counsel while in custody. Signed by the Honorable Jeffrey T. Gilbert on 8/7/2015.
