Dunn, No. 2:16-cv-0733-WKW with the remaining pending cases in the Midazolam Litigation (Doc. # 230 in Grayson v. Dunn, 2:12cv316) is GRANTED. (2) Pursuant to Federal Rule of Civil Procedure 42(a), the court finds that Jeffrey 8CF5756 v. Jefferson S. Dunn, No. 2:16-cv-0733-WKW and the Midazolam litigation, Grayson v. Dunn, et al., 2:12-cv-316-WKW, involve common questions of law and fact and that consolidation will promote judicial economy, eliminate duplication of discovery, and avoid unnecessary costs. The lead case shall be Civil Action No. 2:12-cv-316, and all pleadings, motions, briefs, orders, and other documents shall be filed only in the lead case. (3) This consolidation incorporates all briefing related to the pending Consolidated Motion to Dismiss (Doc. # 160) in the Midazolam Litigation, Plaintiffs' Consolidated Response thereto (Doc. # 170), and Defendants Reply to Response. (Doc. # 174.) (4) If the Consolidated Motion to Dismiss (Doc. # 160) is denied, the parties will have thirty (30) days from the date of the order denying such motion within which to conduct fact discovery that will be limited to claims and information contained in the new complaints in these matters that differ from those in the complaints filed in the Midazolam Litigation. Defendants shall file a consolidated answer to the new cases within fourteen (14) days of a denial of a motion to dismiss. (5) Defendants shall file any motions for summary judgment no later than twenty-one (21) days from the end of the thirty (30) day limited discovery period; Plaintiffs' response is due to be filed within twenty-one (21) days thereafter, and Defendants' reply is due to be filed within seven (7) days thereafter.
