- alnd;;7:17-cv-01375_de5 RegisterActionDescriptionText "ORDER OF CONSOLIDATION - On August 14, 2017, a second habeas petition filed by the plaintiff was transferred to this court by the United States District Court for the Western District of Texas and was assigned case number 7:17-cv-01375-LSC-TMP in this court. The petition appears to request the same relief sought in 7:16-cv-1943-MHH-TMP. Rule 42, Federal Rules of Civil Procedure, provides for the consolidation of causes of action when there are common questions of law or fact, when a decision in one case may be dispositive of the issues in other cases, and/or when a consolidation of the causes will result in consistent orders or dispositions and judicial economy. In this instance, the plaintiffs claims in the above cases are virtually identical. The court therefore finds that consolidation will likely result in consistent orders and dispositions and will result in judicial economy.
