It is entirely unclear to the Court why Thiessen v. General Electric Capital Corp., 267 F.3d 1095 (10th Cir. 2001) -- the only authority cited by the parties for that request -- compels the dismissal of Ms. Peterson's claims (much less a dismissal made apparently over Ms. Peterson's own objection). Just as any Plaintiff who has opted in to the litigation, Ms. Peterson has individual claims in this action that she may, at her option, compromise via settlement or pursue to trial; by all appearances, she intends to pursue her claims to trial. The Court assumes that the Plaintiffs' counsel will, consistent with their ethical and fiduciary obligations to their client (see Docket #98-1 at 16), continue to represent Ms. Peterson in the vigorous pursuit of her own claims in this action.
