Unlike criminal cases, there is no provision for the appointment of government-paid lawyers in civil cases. As Magistrate Judge Watanabe noted, this Court is sometimes able to find a volunteer lawyer who will take a case on a pro bono basis. ECF No. 24. However, there is not an infinite list of lawyers willing to accept such appointments. In this instance Judge Watanabe determined that the pending issues were not so numerous or complex as to warrant an effort to find a volunteer lawyer (which might or might be found in any event). There is a short motion for summary judgment pending that raises just one primary issue -- did you exhaust administrative remedies, i.e., the grievance process of the Clear Creed County Detention Facility.
