With that exception, the Court finds that defendant's drug use before and after the incident has marginal relevance, if any, and that such relevance is substantially outweighed by the danger of unfair prejudice. The Court does point out that as to any exclusion of evidence on either side of the case, if the party in whose favor the exclusionary ruling was made, or the party's lawyer, "opens the door" by conduct at trial, the exclusion will be reconsidered.
