Upon such review, the Court finds that, in light of the papers submitted and the arguments of the parties, the motion to dismiss addressing preclusion should be converted to a motion for summary judgment. As such, the Court "should inform the parties of this intention and give them the opportunity to present to the court all material made pertinent to such motion by Rule 56." United States ex rel. Reed v. KeyPoint Gov't Sols., 923 F.3d 729, 753 (10th Cir. 2019) (quotation and citation omitted). Although it appears the parties have submitted all they wish the Court to consider in evaluating the question at hand, in light of the conversion, the Court will allow the parties to file any further supplement on or before Monday, August 17, 2020.
