- cod;;1:16-cv-01917_de283 RegisterActionDescriptionText "ORDER: Upon consideration of Plaintiff's Unopposed Motion for Leave to Restrict 266 , and the applicable rules and case law, and being otherwise fully advised, the Motion 266 is DENIED. Here, Plaintiff (in accordance with the Protective Order) requests two documents be filed under a Level 1 restriction as Defendants Travelers and Hub assert the content of the agency contract at issue contains proprietary information concerning compensation rates, commissions payable, and Hub's scope of authority. The first document is Plaintiff's Reply in Support of Statement of Undisputed Material Facts ("Reply Statement") 267 based on paragraph 17. The Court's review of this information shows the very limited disclosure of Hub's asserted authority is insufficient to support restriction. The second document fares no better. General, limited testimony regarding Travelers and Hub's relationship; that Travelers pays Hub a commission (but no amount is disclosed); or Travelers' actions which are apparently "industry standards" are insufficient to support that disclosure of such testimony releases proprietary information or results in a clearly defined and serious injury. Accordingly, the Clerk shall UNRESTRICT the Reply Statement 267 and Mr. Cushing's testimony 268 . SO ORDERED by Judge Raymond P. Moore on 5/1/2018.
