On January 30, 2018, this Court entered its Order Granting in Part and Denying in Part Motion to Compel Completion and Supplementation of the Administrative Record ("Order") 65 . In the Order, the Court ordered that the Administrative Record already on file be completed or supplemented with, among other documents, the 2003 Conservation Agreement. The Center for Biological Diversity and Mr. 8154AB2 seek clarification as to whether the documents addressing the implementation of the 2003 Conservation Agreement should also be included in the Administrative Record. As the Court stated in the Order, the Administrative Record must contain all documents and materials directly or indirectly considered by the agency. The Court also found that the Fish and Wildlife Service clearly considered the implementation of the 2003 Conservation Agreement and its effect on the viability of the Rio Grande cutthroat trout. Inasmuch as Fish and Wildlife Service clearly considered the 2003 Conservation Agreement's implementation, any unprivileged documents pertaining to its implementation must also be included in the Administrative Record.As to the Joint Motion to Modify the Briefing Schedule, the Court has reviewed the proposed briefing schedule submitted by the parties and finds it to be reasonable. Thus, the Court adopts that proposed schedule. For the foregoing reasons, the Motion to Clarify 69 is GRANTED, and all unprivileged documents in the Fish and Wildlife Service's possession pertaining to the implementation of the 2003 Conservation Agreement shall be included in the Administrative Record. The parties Joint Motion to Modify Briefing Schedule 66 is also GRANTED, and the parties shall file their respective briefs according to the following schedule: 1. The Fish and Wildlife Service shall complete the Administrative Record with the unprivileged documents in its possession pertaining to the implementation of the 2003 Conservation Agreement within 30 days of entry of this order; 2. The Plaintiffs' opening brief shall be filed within 45 days after the additional documents are included in the Administrative Record; 3. The Defendants' response brief shall be filed within 45 days after the Plaintiffs' opening brief is filed; 4. The Defendant-Intervenors' briefs shall be filed within 10 days after the Defendants' response brief is filed; and 5. The Plaintiffs' reply brief, if any, shall be filed within 30 days after the latest date any of the response briefs are filed. by Chief Judge Marcia S. Krieger on 03/01/18.
