The Clerk has reviewed the bill and it does not follow the format requirements set forth in the Hearing Officer's Guide to Bill of Costs Hearings, a copy of which is attached. In particular, the summary charts provided in the bill do not conform to the the information needed to conduct a hearing efficiently - see p. 17 of the Guide for the exact requirements: "All prevailing parties filing a Proposed Bill of Costs must include a simple, readable 12-point font itemized chart or spreadsheet, separated by each category of costs with subtotals, listing the category (e.g., service of summons, deposition transcript, etc.), date the cost was incurred, where the related invoice appears in the Bills attachment, and on what legal grounds the item should be awarded." The summaries should also be filed together in one separate appendix and not dispersed throughout the bill's 179 pages. Accordingly, Plaintiff/Counterclaim Defendant and Third-Party Defendant is directed to file an Amended Proposed Bill of Costs that conforms to the Guide as described above, within seven days of the date of the filing of this notice, or the Bill will be summarily denied. Besides the summary chart deficiency, this matter will go forward and the bill of costs hearing is set for July 28, 2021 at 9:00 a.m. The hearing will be held in Courtroom A201 (2nd floor) of the Arraj U.S. Courthouse. The hearing will be held IN PERSON - the parties are directed to have counsel asserting the Proposed Bill of Costs and opposing counsel presenting objections be physically present for the hearing. Co-counsel can appear by telephone. The Clerk reminds the parties that a Statement of Conferral must be filed no later than the day before the hearing in order to confirm the attempts to reach a settlement on either some or all of the requested costs, per local rule LCivR 54.1, and to confirm the parties have utilized the Guide to Bills of Cost Hearings in their discussions. Finally, THE CLERK STRONGLY ENCOURAGES ALL THE PARTIES TO REVIEW ALL OF THE GUIDE as the basis for being able to reach an agreement as to individual costs items - or preferably - a global settlement, in light of the Rule One directive that the court and PARTIES work to secure the just, speedy, and inexpensive determination of every action and proceeding.
