It is not clear under which authority Plaintiff files his Amended Complaint without leave of Court. Federal Rule of Civil Procedure 15(a)(1)(B) permits a party to file an amended complaint as a matter of course within 21 days after service of a Rule 12(b) motion, but those 21 days expired on January 13, 2017. The Court's order extending Plaintiff's time to respond to the motion to dismiss 44 only extended the deadline established in D.C.COLO.LCivR 7.1(d). The Court is not aware of any authority holding that an extension of the D.C.COLO.LCivR 7.1(d) deadline automatically extends the Rule 15(a)(1)(B) deadline. Moreover, the Scheduling Order's 39 February 20, 2017 deadline for amendment of pleadings is not a grant of authority to amend the pleadings despite Rule 15(a). Thus, there is a fair argument that Plaintiff's Amended Complaint is unauthorized, and that Plaintiff has failed to timely file a response to the Motion to Dismiss. However, rather than entangle the Court and the parties in resolving this complicated procedural question, the Court finds it in the interest of justice under Rule 15(a)(2) to sua sponte GRANT LEAVE (retroactively) to Plaintiff to file his Amended Complaint. In that light, the Motion to Dismiss Plaintiff's original complaint is DENIED AS MOOT. See Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991) ("It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect."); Glass v. The Kellogg Co., 252 F.R.D. 367, 368 (W.D. Mich. 2008) ("Because the original complaint has been superseded and nullified, there is no longer a live dispute about the propriety or merit of the claims asserted therein; therefore, any motion to dismiss such claims is moot."). Finally, the Motion to Stay, which depends on the existence of the Motion to Dismiss, is likewise DENIED AS MOOT. SO ORDERED by Judge William J. Martinez on 01/30/2017.
