- cod;;1:16-cv-02221_de102 RegisterActionDescriptionText "ORDER denying 102 MOTION to Act. There is no such thing as a motion to act. Your case has been dismissed by the Court as to all defendants except Deputy Mozatti. As against him, your only claim is based on your allegation that he used disciplinary segregation and death threats to retaliate for your filing grievances. Your claim for compensatory damages as a remedy for that claim against Deputy Mozatti has also been dismissed by the Court. At this point, then, your case boils down to a request for an injunction to prevent Deputy Mozatti from retaliating against you for filing grievances, maybe nominal damages of one dollar, possibly some amount, probably a small amount, for punitive damages if you can prove willful and wanton or malicious retaliation. What you need to do at this point is think about whether you still want to proceed with what is left of your case, and perhaps have some communication with the lawyers representing Deputy Mozatti. If the case is not dropped or resolved, then you and the lawyers for Deputy Mozatti need to set it for a trial. I request that you not continue to file motions like "motion to act" that have no relationship to what is left of the case. By Judge R. Brooke Jackson on 12/14/17. Text Only Entry (rbjsec.)
