Ordinarily the Court would not permit the filing of a motion for summary judgment at such a late date, particularly where, as here, the defense has already filed summary judgment motions. However, I grant this motion for two reasons. First, the Court has two cases set for trial beginning August 13. Therefore, there is a significant chance that this trial might have to be continued to a later date. Second, defendant counsel explains that a new computerized system for tracking grievances has discovered information not previously discovered which, according to the motion, indicates that the plaintiff did not exhaust his administrative remedies vis-a-vis defendant Mozatti. The Court has not yet reviewed the motion or its supporting materials, but if there is in fact evidence that the plaintiff did not exhaust his administrative remedies, then the case would be dismissed even if it went to trial. That would be an unnecessary waste of juror time and expense to the parties. Accordingly, the Court directs the plaintiff to file as prompt a response to the motion as possible so that the Court can consider both sides' positions before the scheduled trial date, if possible.
