Counsel for Plaintiff states that her health issues are not fully resolved and that she thus "has come to the decision that she is not able to resume her full work schedule and cannot currently represent Plaintiff in this Federal Court matter, by herself, as a sole practitioner." Plaintiff's counsel represents that she is in the process of contacting additional counsel to associate with or to take over the representation but has not yet located additional counsel. Plaintiff thus requests that the Court convert the Scheduling Conference set for 6/13/2018 into a status conference. The Court has granted Plaintiff numerous extensions in this case and has repeatedly explained to Plaintiff that the Court cannot indefinitely suspend resolution of this case, which has been pending for approaching two years. On May 11, 2018, the Court cautioned the parties that the Court was not inclined to grant any further extensions and that a failure to comply with the current deadlines may result in the imposition of sanctions. [#124] The Court further reminded counsel for Plaintiff of her obligation to withdraw from the representation if her medical issues rendered her unable to represent the interests of her client. [Id. (citing Colorado Rule of Professional Conduct 1.16(a)(2))] Because Plaintiff's counsel has not filed a motion to withdraw, the Court understands that, despite her ongoing medical issues, she is able to proceed with the representation of her client. The Court thus DENIES Plaintiff's request to convert the Scheduling Conference into a Status Conference, which would indefinitely delay the resolution of this case. Waiting for Plaintiff to locate counsel to associate and meaningfully assist in preparation of a proposed pretrial order would result in too significant of a delay at this stage of the case and appears unnecessary. To the extent Plaintiff wishes to associate counsel to assist at trial, Plaintiff may raise that issue with Judge Arguello, who will set the trial date in this matter. Accordingly, the Court will proceed with the Final Pretrial Conference set for 6/13/2018 11:30 AM and the parties shall submit a joint proposed pretrial order on or before 6/08/2018.
