The IAC argument that petitioner, now represented by counsel, wishes to raise is closely related to one of the two arguments raised by the petitioner pro se. It concerns whether petitioner's rights were violated when the five hearing-impaired prospective jurors were excused, but it focuses on trial counsel's asserted failure adequately to object to the exclusion of the jurors. It is an issue worthy of briefing and resolution by this Court, and I perceive no unfair prejudice to the respondents in having that done. Rather, in the ends of justice, the issue merits a full examination. The heinous nature of the underlying crime of which the petitioner was convicted does not change the constitutional issue.
