The Court hereby ORDERS as follows: (1) Plaintiff's Motion for Ruling and/or Hearing 28 is DENIED AS MOOT. The Court has ruled on this matter and attributes the timing of Plaintiff's filing to mail delay. (2) Plaintiff's Motion for Reconsideration 34 is DENIED. In this Circuit, grounds warranting a motion to reconsider include (1) an intervening change in the controlling law, (2) new evidence previously unavailable, and (3) the need to correct clear error or prevent manifest injustice. Servants of the Paraclete v. Does, 204 F.3d 1005, 1012 (10th Cir. 2000). Plaintiff fails to meet any of these standards. Per the Court's prior Orders 19 & 26 , Magistrate Judge Watanabe is designated to conduct proceedings pursuant to 28 U.S.C. § 636(b)(1)(A) & (B) and Fed. R. Civ. P. 72(a) & (b), subject to objection and review by the undersigned as the Presiding Judge.
