In the latter case the Court agreed with evidence presented by the Rabbi that electric candles are a suitable substitute for actual candles, and that there are ways to accommodate the rituals of Shabbatt and Havdolah which meet the legitimate concerns of both the inmate and the facility. The Court assumes that there might be ways to accommodate mutual interests regarding clothing items and religious services that acknowledge, on the one hand, that an individuals religious rights must be respected, but recognize, on the other hand, that legitimate penological interests must also be respected. Before charging into full-blown litigation, the Court directs defense counsel to meet with the Rabbi and appropriate CDOC officials to consider whether Mr. 8F39CB0 has raised legitimate issues that can be met with reasonable modifications of practices without the need for further litigation.
