- cod;;1:16-cv-02815_de8 RegisterActionDescriptionText "MINUTE ORDER: This matter is before the Court sua sponte upon consideration of the Notice of Removal 1 . Defendant removed this action from the District Court, Adams County, Colorado, alleging diversity jurisdiction. Diversity jurisdiction requires complete diversity of citizenship between the parties. Here, Defendant conclusorily alleges that Plaintiff's members are citizens of Colorado, without any support. Plaintiff's Complaint alleges it is a domestic limited liability company; it does not allege the citizenship of its members. Such allegations are insufficient. See Siloam Springs Hotel, L.L.C. v. Century Sur. Co., 781 F.3d 1233, 1234 (10th Cir. 2015) (citations omitted) (an LLC, as an unincorporated association, takes the citizenship of all its members) Accordingly, the Court is unable to determine that complete diversity of citizenship exists. It is therefore ORDERED that on or before Monday, November 28, 2016, Defendant shall SHOW CAUSE why this case should not be remanded from where it was removed due to this Court's lack of subject matter jurisdiction. SO ORDERED by Judge Raymond P. Moore on 11/21/2016. (Text Only Entry) (rmsec ) (Entered: 11/21/2016)" @default.
