- cod;;1:16-cv-02925_de61 RegisterActionDescriptionText "ORDER granting 58 MOTION for Leave to Amend Answer. On review of the motion, response and reply, and without commenting on the merits of the amended or added affirmative defenses, the Court finds that there is good cause to permit the defendant to amend. There is no indication of unfair prejudice. The discovery cut-off is May 31, 2019, and if plaintiff reasonably needs additional time for discovery (or designation of experts) because of the amendments, the Court would accommodate him. The trial is not imminent, having been set for October 28, 2019. Rule 15(a)(2) directs courts freely to grant leave to amend pleadings when justice so requires. I find that justice so requires, and the motion for leave to amend is granted. I do note, however, that defendant has not complied with D.C.COLO.LCivR (local rule) 15.1(b), and defendant is directed to file a "red-lined" verson as well as a clean version of its amended answer. By Judge R. Brooke Jackson on 4/17/19. Text Only Entry (rbjsec. ) (Entered: 04/17/2019)" @default.
