As an initial matter, defense counsel is advised that the Court takes considerable umbrage at the tone and tenor of her Motion. The Motion is replete with statements and innuendoes which appear to accuse the undersigned of setting and re-setting criminal hearings guided by nothing more than caprice and undisciplined discretion. Counsel may wish to reflect on the fact that for 27 months this District Court has had only 6 active status Article III judges to preside over all of the felony proceedings in a District the population of which is quickly approaching 5 1/2 million. By way of comparison, the Northern District of Illinois, with a shrinking population of now less than 10 million, enjoys the happy circumstance of being authorized for 22 Article III judges. Counsel is advised, once again, that the Court schedules and reschedules hearings in criminal cases at the earliest practicable date, and has no interest whatsoever in prolonging any criminal proceeding, and especially in unnecessarily and without justification prolonging the period any defendant serves in custody. Counsel would do well to keep this in mind before filing similar such motions in the future. Notwithstanding the foregoing, and solely in the interest of justice and after adjusting the Court's docket in order to be in a position to partially accommodate Defendant's request, the instant Motion is GRANTED IN PART for good cause shown. The Sentencing Hearing set for August 28, 2018 is hereby VACATED and RESET to July 13, 2018 at 10:00 a.m. in Courtroom A801. Counsel are directed to this Court's Revised Practice Standards with regard to the deadlines for filing sentencing-related motions. SO ORDERED by Judge William J. Martinez on 6/7/2018.
