- cod;;1:17-cv-00693_de106 RegisterActionDescriptionText "MINUTE ORDER Re: Duration of Depositions: This morning, Plaintiff's Counsel contacted the Court pursuant to §E(3) of Magistrate Judge Crews' Civil Practice Standards requesting the Court's assistance with an urgent Discovery issue. Plaintiff's counsel informed the Court that the Parties had disagreement regarding the duration of depositions in this matter. Accordingly, the Court clarifies as follows:1. Pursuant to Fed. R. Civ. P. 30(d)(1), depositions are limited to 7 hours.2. "For purposes of this durational limit, the deposition of each person designated under Rule 30(b)(6) should be considered a separate deposition." Advisory Committee Notes to 2000 Amendment, Fed. R. Civ. P. 30(d). Thus, a party has 7 hours to depose each 30(b)(6) designee.3. The durational limit is capacity-specific, subject to the limits of the Scheduling Order. The Scheduling Order does not alter the presumptive durational limit under the Federal Rules. [See ECF. # 45 .] Thus, a party shall have 7 hours to depose a person as a 30(b)(6) designee and may depose that same person for an additional 7 hours, in their individual capacity. See Fed. R. Civ. P. 30(d)(1) (requiring the Court to allow additional time consistent with Rule 26(b)(1) and (2)).The Court reminds counsel for both Parties that §E(3) requires that an attorney for each party to a dispute be on the phone to discuss discovery matters. The issuance of this order should not be construed as condoning Plaintiff's Counsel's failure to abide by this requirement.
