Under the Courts soon-to-be issued revised Practice Standards, the Court will not consider motions to dismiss unless the parties have met and conferred and informed the Court of the issues warranting a motion to dismiss. For a case plan, the parties should set forth at least the following dates: (1) amendment of pleadings/joinder of parties; (2) disclosure of experts; (3) discovery cutoff; (4) date for submission of notice of intent to file a motion for summary judgment. This will be explained in the forthcoming Practice Standards.
