It is clear from a review of the Motion that the discovery dispute between the parties has existed for several weeks, at minimum. However, neither party brought this dispute to the Court's attention. Rather, Defendants issued subpoenas that they should reasonably have anticipated would draw an objection from the Plaintiff. Plaintiff, in turn, waited nearly two weeks to file his Motion to Quash. This Court's practice standards are intended to assist in resolving such disputes without resorting to motions practice. Furthermore, they are not to be considered optional. Consequently, the Court DENIES the Motion without prejudice. IT IS FURTHER ORDERED that the Court MODIFIES those subpoenas by STAYING the subpoena deadlines pending the parties' compliance with this Court's practice standards regarding discovery disputes. IT IS ORDERED that the parties shall engage in further, meaningful conferral (simple e-mail exchanges will not suffice) in an attempt to resolve this dispute without further Court intervention. In the event that resolution is not possible, Counsel for the parties shall follow this Court's practice standards and jointly contact Judge Crews' chambers to receive further instructions.
