Upon review of the Motion, it appears that 18 U.S.C. § 983(b) may be applicable. Under that statute, a court may appoint counsel to represent a claimant in a civil forfeiture action in two specifically enumerated circumstances: (1) where the claimant is unable to afford counsel and the claimant is represented by court appointed counsel under 18 U.S.C. § 3006A in a related criminal case; or (2) where the claimant is unable to afford counsel and the real property at issue is being used by the claimant as a primary residence. 18 U.S.C. § 983(b). Accordingly, Claimant E289F6B shall file a brief addressing whether these circumstances apply on or before 4/7/2020. The government shall file a response on or before 4/21/2020. In light of this Order, the Scheduling Conference set for 4/9/2020 9:00 AM is VACATED and RESET for 5/26/2020 11:00 AM in Courtroom A 402 before Magistrate Judge Scott T. Varholak. Proposed Scheduling Order due by 5/19/2020. Claimants may participate in the Scheduling Conference telephonically by calling the Court at 303.335.2365 at the scheduled date and time.
