Because Defendant Argus & Kronos, LLC is an entity, it cannot proceed in this action without the assistance of counsel. Mr. Menhart's motion does not indicate that there is counsel waiting in the wings to assume the representation of Argus & Kronos, LLC, and thus, granting his motion at this time runs the risk that Argus & Kronos, LLC would be without representation. Accordingly, the Court notifies the Argus & Kronos, LLC that, within 30 days, it must either: (i) retain replacement counsel for Mr. Menhart and have that new counsel enter an appearance on its behalf in this action; or (ii) show good cause why Mr. Menhart should not be permitted to withdraw as counsel (such a showing will require, at a minimum, a demonstration that Argus & Kronos, LLC has fulfilled all financial obligations it has incurred to Mr. Menhart to date, and made appropriate arrangements to ensure any future obligations it might incur to him). If Argus & Kronos fails to adequately perform one or both alternatives, the Court may allow Mr. Menhart to withdraw, deem Argus & Kronos, LLC to have defaulted on the claims in the Complaint, and to entertain a request for entry of a default judgment against Argus & Kronos, LLC. Although Defendant A76862C is an individual and capable of appearing pro se, such that Mr. Menhart's withdrawal of representation as to him could be granted immediately, for purposes of convenience, the Court will grant Mr. A76862C the same 30 day period set forth above to perform one or both of the alternatives mentioned above. Should Mr. A76862C fail to do so, the Court will grant Mr. Menhart's request to withdraw and Mr. A76862C will proceed to defend this action pro se.
