- cod;;1:17-cv-02022_de40 RegisterActionDescriptionText "ORDER TO SHOW CAUSE: Mr. Robledo-Valdez commenced this action in or about August 2017, and in a September 2017 Amended Complaint 7 , first alleged calims against Defendants identified as "Mr. 3483F8F," "Ms. 11AD7AC," and "Ms. C2E5FE8," subsequently identified as Josh Lang, Judith Middleweek, and C2E5FE8 Swerdfinger. Mr. Robledo-Valdez first attempted to serve these Defendants in October 2017 at the Jefferson County Sheriffs' Office 14 . These Defendants specially appeared and moved to quash that service as defective, alleging that they were employees of Aramark, and had never been employed by the Jefferson County Sheriff. In May 2018, the Court granted 21 the motion and quashed service on these three Defendants. In June 2018, Mr. Robledo-Valdez requested 25 that the Marshall attempt to serve these Defendants at another address, purportedly for Aramark, in Morrison, Colorado. The Court granted 36 that motion in August 2018. The Marshall attempted to serve the Defendants at the listed address 37 in September 2018, but was unusccessful, noting that the listed address did not exist. Other than requesting an update on the status of this matter in June 2019, Mr. Robledo-Valdez has not otherwise pursued his claims against these (or any other) Defendants.Fed. R. Civ. P. 4(m) provides that "if a defendant is not served within 90 days after the complaint is filed, the court -- on motion or on its own after notice to the plaintiff-- must dismiss the action without prejudice against that defendant or order the service be made within a specified time." This Court notes that Mr. Robledo-Valdez's claims against the Defendants named above have been in asserted since September 2017, two full years, and Mr. Robledo-Valdez has yet to perfect service upon these Defendants. Mr. Robledo-Valdez has made two unsuccessful attempts to serve these Defendants in that time. The Court is inclined, consistent with Rule 4(m), to dismiss the claims agaisnt these Defendants for failure to serve. Within 14 days of this Order, Mr. Robledo-Valdez shall show cause why the claims against these Defendants should not be dismissed for failure to timely effect service pursuant to Fed. R. Civ.
