R. Evid. 702. Previously, the Court's Rule 702 procedure favored resolution of disputes via an evidentiary hearing in which the proffered expert was called to testify. To avoid the need for expensive and potentially-unnecessary evidentiary hearings, the Court now intends to consider Rule 702 challenges on paper, setting hearings only if necessary. To effectuate that process, however, the Court will require more detailed motions and briefing than were required under the prior procedure. Accordingly, the Court denies, without prejudice, the parties' current Joint Rule 702 Motion.Within 21 days of this Order, the party opposing the proffered opinion testimony shall file a motion that sets forth the factual and legal basis for the Rule 702 challenge, attaching whatever evidentiary material that party believes is necessary to permit the Court to decide the matter. The party proffering the opinion testimony may respond to that motion within 14 days of its filing, attaching whatever additional evidentiary material is necessary for full presentation of the issue. A reply brief, if any, may be filed within 7 days of the response brief.
