But the motion does not indicate how much of an extension is requested, just that she needs time to retain an attorney for limited representation. Frankly, that appears to be unrealistic. The Trial Preparation Conference, where we discuss and attempt to finalize jury instructions, will occur in two days September 18, 2020 at 1:30. I doubt that the plaintiff can find an attorney who is willing to provide limited representation for the purposes of preparing proposed jury instructions in two days. The Trial Preparation Conference is not the final opportunity to consider jury instructions, but it is the time when we prepare for the trial. The trial is only a month away. We will discuss trial procedures and pandemic procedures, but ultimately, the parties will have to participate in jury selection and presenting their case to a jury. The judges today will discuss en banc whether our "pilot trial" program will be extended through October. If so, this case may or may not be approved by the Chief Judge for trial as scheduled. But it is a very old case, and it needs to be resolved. The parties might wish to revisit the discussions they had in their settlement conference to see if their positions have changed at all.
