- cod;;1:17-cv-02652_de45 RegisterActionDescriptionText "ORDER denying 42 MOTION to Continue Trial Preparation Conference, Trial, and Related Deadlines, and Request for Expedited Consideration. Defendant requests a 30-45 day continuance of the trial. However, the first dates on the Court's docket when it could re-set the case for a four-day trial without setting it over cases already set would be May 26 or July 6, 2020. For most of the weeks before that the Court has as many as three or four cases already set. Defendant has elected, just over a month before trial, to bring in new counsel and has selected counsel who is unavailable on the existing trial date. Those are not reasonable grounds to make plaintiff wait another year for her trial. The Court has investigated whether a criminal trial set for July 8, 2019 might be a disposition, but as of today counsel have informed the Court that they expect to go on that date. I have no other reasonable options to offer. That said, I inform the parties that the Court is scheduled to try a case in Grand Junction, Colorado the week of June 17, 2019, and as of today's date, that case is still going forward. That case has an earlier case number. Accordingly, it is possible that the defendant will get its wish for that reason. But you should plan on going to trial on June 17, 2019 unless you hear from the Court otherwise. By Judge R. Brooke Jackson on 5/14/19. Text Only Entry(rbjsec. ) (Entered: 05/14/2019)" @default.
