- cod;;1:17-cv-03008_de63 RegisterActionDescriptionText "ORDER granting 57 MOTION in Limine to Exclude Evidence Related to Plaintiff's Alleged Romantic Relationship with Teri Moody. The bases provided for the relevance of the information in plaintiff's response, ECF No. 62, are not convincing. One can explain that Ms. 6622902 relocated due to a friendship with Ms. Moody without indicating that they had a romantic relationship. Because Ms. Moody appears to have been involved in observing alleged misconduct by Ms. 6622902, and in corrective actions and perhaps the ultimate termination decision, the relationship could be relevant if a breakup or other rupture in the relationship potentially motivated retaliatory conduct by Ms. Moody. However, that has not been alleged. As alleged, the jury can assess Ms. Moody's conduct on its merits without knowledge of a romantic or former romantic relationship between them. For similar reasons, the fact of the romantic relationship, without something more that potentially ties it to adverse employment actions, does not affect her credibility. The statement that "Ms. Moody's past romantic relationship with Plaintiff could definitely impact her credibility to tell the truth, especially as it pertains to her actions against Ms. 6622902," ECF No. 62 at 4, is a conclusory assertion that lacks meaningful explanation. Thus, absent more, the Court finds that evidence of the romantic relationship is not relevant to the issues to be decided in the case. By Judge R. Brooke Jackson on 5/2/19.
