This matter is before the Court on the 36 MOTION to Appoint Counsel filed by E52AE90, and the 37 MOTION to Appoint Counsel filed by 607325F (the "Motions"). Upon review of the Motions, it appears that 18 U.S.C. § 983(b) may be applicable. Under that statute, a court may appoint counsel to represent a claimant in a civil forfeiture action in two specifically enumerated circumstances: (1) where the claimant is unable to afford counsel and the claimant is represented by court appointed counsel under 18 U.S.C. § 3006A in a related criminal case; or (2) where the claimant is unable to afford counsel and the real property at issue is being used by the claimant as a primary residence. 18 U.S.C. § 983(b). Accordingly, Claimants shall each file a brief addressing whether these circumstances apply on or before 4/23/2019. The government shall file a response on or before 4/30/2019.
