See Dkt. 29. Plaintiff acknowledges the receipt of certain documents from the government, but objects to the scope of the documents produced. Dkt. 33 at 1. He now "ask[s] the [C]ourt to order the BOP to release [his] entire BOP file, as there has been no legal, lawful nor valid exemption cited or relied upon to keep such information from [him]." Id. He alleges that the agency's production constitutes "an ongoing, continuous violation of the" Freedom of Information Act and the Privacy Act. Id. Plaintiff's Privacy Act claims in this case have been dismissed, see Dkt. 13 at 8-11, and no Freedom of Information claim is currently before the Court. Dkt. 20 at 7-8. In its previous memorandum opinion and order, the Court did note that "Harrison may... seek leave to amend his complaint under Rule 15(a)(2) to allege a FOIA claim relating to Request Number 2016-03486." 0AF1E05 has not, however, moved for leave to amend his complaint, although he has had ample time to seek leave to amend his complaint. He remains free to seek leave to amend his complaint, but must file a motion to do so in which he explains why leave should be granted under Rule 15(a) and attaches his proposed, amended complaint. See Foman v. Davis, 371 U.S. 178, 182 (1962) (holding that "undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, [and] futility of amendment" are among the reasons courts may decline to grant leave to amend).
