- flsd;;1:16-cv-20904_de29 RegisterActionDescriptionText "ORDER denying 27 Motion to Compel; denying as moot 28 Motion for Discovery Conference. The motion to compel is Denied as procedurally defective. Local Rule 26.1(g)(1) provides in material part that "all motions related to discovery, including but not limited to motions to compel discovery... shall be filed within thirty (30) days of the occurrence of grounds for the motion. Failure to file a discovery motion within thirty (30) days, absent a showing of reasonable cause for a later filing, may constitute a waiver of the relief sought." This Rule "reflects a policy of promoting the prompt resolution of discovery disputes by requiring the parties to timely bring to the Court's attention matters that the parties cannot resolve amongst themselves." Kendall Lakes Towers Condo. Ass'n, Inc. v. Pac. Ins. Co., 2011 WL 6190160, at *2 (S.D. Fla. Dec. 2, 2011); see, e.g., Manno v. Healthcare Revenue Recovery Group, LLC, 2012 WL 1409532, at *2-3 (S.D. Fla. Apr. 23, 2012) (finding the occurrence of grounds for a motion to compel discovery to have occurred when the party seeking discovery received notice of the opposing party's objections to his discovery requests).Plaintiff has not demonstrated any reasonable cause for not filing a motion to compel within thirty days of Defendant's response to Plaintiff's June Discovery Requests. The motion was filed well over three months after the Rule's 30-day deadline. The facts cited in Plaintiff's motion do not come close to setting forth material good cause to exempt operation of the Rule in this circumstance. The denial of this motion does not preclude Plaintiff from seeking any other timely discovery (via deposition or otherwise) prior to the discovery cutoff and in accordance with the Court's Rules.Because the motion to compel has been adjudicated, a status conference is not necessary.Docket Order Signed by Magistrate Judge Edwin G. Torres on 12/19/2016. (EGT) (Entered: 12/19/2016)" @default.
