- gand;;1:10-cv-00596_de31 RegisterActionDescriptionText "NON-FINAL REPORT AND RECOMMENDATION with Order for Service Recommending that the 17 Motion to Dismiss 1 Complaint be GRANTED IN PART and DENIED IN PART. Defendant Keller's motion should be GRANTED such that Defendant Keller should be DISMISSED from the case. The remainder of the motion to dismiss should be DENIED. If this Report and Recommendation is adopted, (1) the Clerk is DIRECTED to forward a copy of this Order and a copy of Plaintiff's complaint to Warden Keller at the following address: Warden, U.S.P. Atlanta Penitentiary, U.S.P. Atlanta Penitentiary, 601 McDonough Blvd, S.E., Atlanta, Georgia 30315; (2) the Warden is ORDERED, within 30 days of the date the District Judge adopts this report and recommendation, to submit to this Court the full names and last known addresses of the correctional officers on duty at USP-Atlanta's federal holding facility on September 4, 2008, who were involved in the complained-about events so that this Court may serve them. Plaintiff's complaint indicates that prior to the alleged incident of excessive force, a fight broke out between Wilfrado, Torres-Horeno (Federal Register Number 23391-051) and another inmate, and that Plaintiff received medical attention from C. Glas, MLP approximately one hour after the alleged excessive force. This information should help limit the number of records that need to be searched to identify the defendants' information. Should Warden Keller fail to respond to this Order, the Clerk is DIRECTED to RESUBMIT this case to the undersigned at the expiration of the aforementioned 30-day period. (When the Court receives the information from Warden Keller, it will direct the Clerk to serve the Atlanta United States Attorney and the United States Attorney General in addition to the unknown six defendants, as discussed previously in Section III.A.) Signed by Magistrate Judge C. Christopher Hagy on 8/9/2011. (mdy) (Entered: 08/09/2011)" @default.
