Plaintiff's claims that Doctor Barlow, Captain Cook, Major Nelson, and Lieutenant Sloan were deliberately indifferent to his serious medical needs are ALLOWED TO PROCEED. The Clerk is DIRECTED to send Plaintiff USM 285 forms and summons for the Defendants. Plaintiff is DIRECTED to complete forms for each of the Defendants and return completed forms to the Clerk within 20 days of the entry date of this Order.. Plaintiff is warned that failure to comply is a timely manner could result in the dismissal of the civil action. The Clerk is DIRECTED to resubmit action if the Plaintiff fails to comply. Upon receipt of the completed forms, the Clerk is DIRECTED to prepare and mail a service waiver package and notice of lawsuit for Defendant. In the event the Defendant does not return the Waiver of Service form to the Clerk of Court within 35 days following the date the service waiver package was mailed, the Clerk is DIRECTED to prepare and transmit to the U.S. Marshal's office a service package for Defendant. Upon receipt the Marshal's Service is DIRECTED to personally serve Defendant. The executed waiver or completed USM 385 form shall be filed with the Clerk. The Plaintiff shall be required to serve upon defendant or defendant's counsel copies of all additional pleadings submitted to the Court. Plaintiff is also required to keep the Court and Defendant advised of Plaintiff's current address at all times during the pendency of this action. Failure to do so may result in dismissal of complaint. This case SHALL PROCEED on a 4 month discovery track, beginning 30 days after the first appearance of a Defendant by answer to the Complaint, subject to extension by motion filed prior to the expiration of that discovery period.
