The Pretrial Conference was scheduled for 2:00 p.m. The Court began the conference without Defendants' counsel, Deirdre Stephens-Johnson, at 2:12 p.m. The conference was postponed until 3:00 p.m. after receiving information that Ms. Stephens-Johnson was on her way to the courthouse. The Court set a Jury Trial date for June 11, 2018 at 9:30 a.m. All subsequent days of trial will begin at 9:00 a.m. Additional telephonic pretrial conference have been set for Wednesday, June 6, 2018 at 2:00 p.m. and Friday, June 8, 2018 at 3:00 p.m., if needed. Plaintiffs and Defendants shall have 30 minutes each side for voir dire questioning. Plaintiffs shall have 30 minutes for opening statements, and Defendants shall have a total of 40 minutes for opening statements. Defendants counsel shall confer on how they would like to split the 40 minutes for opening statements. The Court deferred ruling on the amount of time each side shall have for closing argument. Before the final pretrial conference, the parties shall confer on any exhibits to be used during opening statements to see if there are any objections. The parties are requested to confer and provide the Court with a summary of the case before noon on Monday, June 4, 2018. The summary should be no longer than one paragraph in length and should be filed on CM/ECF as well as emailed to Ms. Bachelor in Word format. Consolidated jury charges, Plaintiffs' proposed jury charges, Defendants' proposed jury charges and any objections to the opposing sides' jury charges and both parties' verdict forms shall be filed on CM/ECF and emailed to Ms. Bachelor in Word format before noon on Friday, June 8, 2018. The parties shall inform the Court during final pretrial conference if they want to charge the jury prior to closing arguments or after closing arguments. The parties shall consult the Federal Rules of Civil Procedure regarding deposition designations and live testimony at trial. Deposition designations are due May 29, 2018. Counter-designations and objections are due June 1, 2018. The parties are directed to confer on the objections to the designations and submit to the Court a list of remaining objections by noon, Monday, June 4, 2018. The parties are directed to file the depositions on CM/ECF. If the objection relates to a deposition exhibit, the exhibit must be provided. Trial briefs are due May 29, 2018. Responses to Trial Briefs are due June 4, 2018. Final witness and exhibit lists shall be filed on CM/ECF on Friday, June 8, 2018. The parties shall trade objections to each others' exhibits and email Ms. Bachelor prior to the final pretrial conference regarding any significant issues pertaining to the exhibits along with a copy of the objected to exhibits. The Court requested the parties provide a notebook of their exhibits with tabs with the exhibit number to be delivered to chambers the morning of trial. The parties shall confer regarding their voir question objections and notify the Court by Thursday, May 31, 2018 if any objections remain. The Court orally referred this case to Judge Baverman for mediation. Defendant D892DF6 shall have until Wednesday, May 2, 2018 to object to the case being referred to mediation. The Court made the following rulings on Defendant 3FAEE9D, Jr.s' Motion in Limine 85 : the motion is DENIED as to Plaintiffs' exhibit 13 and the bank check and records evidence; the motion is GRANTED as to Plaintiffs' exhibit 14. Defendants are free to object at trial. The Court DEFERRED ruling on the motion as to Plaintiffs' exhibits 39, 40 and 43. Plaintiffs should edit the videos to include only what will be used at trial regarding exhibits 39, 40 and 43 and resubmit the videos to the Court and opposing counsel. Plaintiffs' counsel shall provide the court with a trial brief regarding the settlement agreements in related case evidence by May 29, 2018.
