Defendant seeks aprotective order related to third-party subpoenas served by Plaintiff on twononparties that formerly served as third-party sales representatives forDefendant. Defendant asserts that Plaintiff is seeking information that theCourt has previously ruled is inadmissible. Defendant further asserts that thedocuments sought by Plaintiff are confidential and competitively sensitive.In response, Plaintiff asserts that Defendant lacks standing to move for an order to protect the rights of a nonparty witness if that witness does notclaim protection for himself. The Court agrees. Therefore, the motion for aprotective order is due to be denied on this ground alone. However, moving tothe merits of the motion, the Court finds that a protective order is notwarranted. While the Court previously granted Defendant a protective order asto much broader requests by Plaintiff, the Court finds that the present requestsare more narrowly tailored to obtain only information that could be relevant tothe present dispute. As for Defendant's confidentiality concerns, the protectiveorder 35 presently in place affords the parties adequate protection.Defendant's motion for a protective order is DENIED.
