(ECF No. 214 ).While on appeal to the Ninth Circuit Court of Appeals, on July 30, 2020, Defendant filed a Motion for Compassionate Release pursuant to 18 U.S.C. § 3582(c)(1)(A) in the District Court. (ECF No. 237 ).On August 17, 2020, the Government filed its Response in Opposition. (ECF No. 242 ). The following day, on August 18, 2020, the Government filed a Supplement to its Response in Opposition. (ECF No. 246 ).On September 15, 2020, the Government filed a Second Supplement to its Response. (ECF No. 247 ). In its Second Supplement to its Response, the Government argues that the District Court lacks jurisdiction to consider Defendant 97BA634 Motion for Compassionate Release because her appeal remains pending before the Ninth Circuit Court of Appeals.On October 28, 2020, Defendant filed her Response to the Government's jurisdictional argument. (ECF No. 256 ).Defendant's appeal remains pending before the Ninth Circuit Court of Appeals. II. ANALYSISThe filing of a notice of appeal confers jurisdiction on the court of appeals and divests the district court of its control over aspects of the case involved in the appeal. United States v. Ortega-Lopez, 988 F.2d 70, 72 (9th Cir. 1993). The district court lacks jurisdiction to modify the length of a sentence in a criminal case while an appeal is pending before the appellate court. Id.; United States v. Melkonyan, 2020 WL 2128591, at *1 (E.D. Cal. May 5, 2020) (citing United States v. Maldonado-Rios, 790 F.3d 62, 64 (1st Cir. 2015) (explaining that a district court cannot modify a sentence either pursuant to Fed. R. Crim. P. 35(b) or 18 U.S.C. § 3582(c) while an appeal is pending before the appellate court)).The District Court lacks jurisdiction to consider Defendant's Motion for Compassionate Release pursuant to 18 U.S.C. § 3582(c) as her appeal remains pending before the Ninth Circuit Court of Appeals. United States v. Carpenter, 2020 WL 5269579, *1 (E.D. Cal. Sept. 4, 2020) (finding the district court lacks jurisdiction over a motion for compassionate release while the appeal is pending).Defendant concedes that the District Court lacks jurisdiction over her Motion for Compassionate Release. (Def.'s Response at p. 2, ECF No. 256 ). Defendant requests that the Court make an indicative ruling pursuant to Federal Rule of Criminal Procedure 37(a)(3).Fed. R. Crim. P. 37(a) provides that "[i]f a timely motion is made for relief that the court lacks authority to grant because of an appeal that has been docketed and is pending, the court may:(1) defer considering the motion;(2) deny the motion; or,(3) state either that it would grant the motion if the court of appeals remands for that purpose or that the motion raises a substantial issue.The District Court declines Defendant's request to provide an indicative ruling to the Ninth Circuit Court of Appeals. See Carpenter, 2020 WL 5269579, at *1 (declining to make an indicative ruling on compassionate release and denying the motion for lack of jurisdiction).Pursuant to Fed. R. Crim.
