The Seventh Circuit Court of Appeals has reversed and remanded the Courts denial of Plaintiff's motion for injunctive relief in which he alleged that he is suffering debilitating pain from mesh, implanted during hernia surgery 167 . The Seventh Circuit directed that the District Court conduct a hearing, finding that: "to evaluate the source of his excruciating pain, medical staff must determine if his mesh implant is part of a national recall" It also recommended that the Court consider appointing counsel for Plaintiff as the hearing, "may require evidence from medical experts" In anticipation of scheduling the hearing, the Court asks Defendants, within 21 days, to identity the serial or lot numbers of the mesh implant. Defendants are also to determine whether the mesh t has been the subject of a product recall. After reviewing Defendants' response, the Court will conduct a telephone status call to schedule the hearing. The Appellate Court had also granted Plaintiff costs of $504.10, with $500 for the filing fee and $4.10 in copying charges. Plaintiff files 271 , a Bill of Costs in this amount. To date, Plaintiff has paid $1.60 of his appellate filing fee. 271 is GRANTED to the extent that the Clerk is to reimburse $1.60 to Plaintiff's trust fund, and cease all collections, as the remainder of the filing fee is waived.
