The Court considers Plaintiff's Motion requesting leave to amend his complaint. 148 . Previously, Plaintiff moved this Court to appoint a special representative, and stated that he would amend his complaint reflect the appointment of the special representative. [143: paragraph 8]. This Court subsequently appointed attorney Rupcich as special representative for Defendant and granted Plaintiff's motion. (T/O of May 8, 2020). Accordingly, the Court also directed Plaintiff to amend his complaint to substitute the special representative for Defendant. Id. On May 22, 2020, Plaintiff filed his Second Amended Complaint substituting the special representative for Defendant and also including an additional count of medical malpractice. 147 . On June 4, 2020, Plaintiff moves for leave to amend his complaint to include the additional claim for medical malpractice. Under Federal rule of Civil Procedure 15, the court should freely give leave to amend a complaint "when justice so requires." "Even so, leave to amend is not automatically granted," and a judge has discretion to deny leave to amend for reasons "including undue delay, the movant's bad faith, and undue prejudice to the opposing party." Crest Hill Land Dev., LLC v. City of Joliet, 396 F.3d 801, 804 (7th Cir. 2005). In October 2019, Defendant"s medical condition necessitated conducting a video deposition of Defendant's to preserve his testimony on the deliberate indifference claim. 149 . Defendant has since passed away. 141 . Based on the filings of the parties, the Court determines that the complaint, in including the medical malpractice claim, would result in unduly prejudice to Defendant and will cause further delay in this case. The Court, therefore, DENIES Plaintiff's motion for leave to amend his complaint. 148 . The Court STRIKES the Second Amended Complaint. 147 . The Court directs the Clerk of the Court to annotate the Second Amended Complaint 147 as "Striken." The Court again grants Plaintiff leave to amend his complaint. Plaintiff shall file an amended complaint, substituting the special representative as a defendant, within 14 days of the entry of this order, without a claim for medical malpractice.
