Essentially, Plaintiff's motion is a request for reconsideration of the denial of his prior motion asking the Court to issue subpoenas on his behalf. Contrary to Plaintiff's contention, the Court is not denying him access to discovery material. Instead, as the Court explained to Plaintiff, he must first seek the information that he believes that he needs to litigate this case from Defendants through a discovery request under Federal Rules of Civil Procedure 33, 34, or 36. Once Plaintiff has done so and if he cannot obtain the information or documents that he needs from Defendants, he may then renew his request for a subpoena to be served upon a third-party. Plaintiff's motion to request counsel 42 is also DENIED. According to the representations that he made in his motions and other pleadings, Plaintiff is highly educated and appears to be capable of litigating this case himself. In addition, Plaintiff's filings indicate that he is working with an organization to help him find counsel to represent him in this case.
