On March 9, 2020, the Court granted summary judgment on Plaintiff's claim alleging deliberate indifference to a serious medical condition. See March 9, 2020, S.J. Order. Plaintiff had one surviving claim alleging Defendant Blackwell used excessive force with the use of chemical spray on June 6, 2016. However, in Plaintiff's response to the dispositive motion, Plaintiff for the first time noted he also intended to allege Defendant Blackwell committed the state law torts of assault and battery. The Court again reviewed the complaint and noted Plaintiff had included these allegations, but he failed to clarify the misapprehension regarding his claims during any of the numerous time his surviving claims were discussed. See March 9, 2020, S.J. Order. The Court set the matter for a status hearing, and the parties indicated an interest in mediation. See July 24, 2020, Minute Entry. The case was referred to the Magistrate Judge, but no settlement was reached. See August 12, 2020, Minute Entry. Therefore, within 14 days of this order, the parties must state in writing whether any additional discovery is needed regarding Plaintiff's state law claims against Defendant Blackwell. If so, the parties should indicate what additional information is required. Finally, the Defendants should state whether a dispositive motion deadline is requested.
