- ilcd;;1:17-cv-01232_de78 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 2/7/2019. Plaintiff claims his constitutional rights were violated at Pontiac Correctional Center when an officer used excessive force based on the use of pepper spray and a nurse was deliberately indifferent to Plaintiff's serious medical condition. Plaintiff alleges a Tact Team was extracting another inmate, but used a copious amount of pepper spray in the area. September 25, 2017 Merit Review Order. The Court recently considered a Motion to Compel discovery and directed Defendants to provide additional information concerning Tact Team Cell extraction procedures. See January 22, 2019 Case Management Order. Plaintiff has now filed a motion for issuance of subpoena asking the Court to order IDOC's Chief of Operations to provide any records, interviews, statements, investigative notes, etc. concerning the use of pepper spray against Plaintiff on June 6, 2016. 55 . Plaintiff does not explain the need for a subpoena. Any investigation would have been conducted at Plaintiffs facility and this information should be available to the Plaintiff through discovery. Plaintiff's motion is denied. 55 . Nonetheless, since Plaintiff is proceeding pro se, Defendants are to state in writing within 21 days whether there was any investigation into the use of pepper spray on June 6, 2016, and whether there is any resulting documentation.
