On August 3, 2018, the Court directed the parties to file any additional exhibits which were not previously provided to the Court on or before August 10, 2018. See August 3, 2018 Text Order. Plaintiff has already filed one motion to present exhibits which was granted. See August 9, 2018 Text Order. Plaintiff has now filed a motion for an extension of time to present additional exhibits. 42 , a motion asking Defendants to disclose any exhibits or witnesses 44 , and a second motion to submit exhibits. 43 . The only issue before the Court during the Pavey hearing is whether or not Plaintiff exhausted his administrative remedies before filing his lawsuit. Although the issue was previously addressed in a summary judgment motion, the Court can consider the credibility of the witnesses and exhibits during a Pavey hearing. The Court would not anticipate either the Plaintiff or the Defendants would have many additional exhibits for the hearing since most documents would already have been submitted in consideration of the summary judgment motion. Therefore, Plaintiff's motion for an extension of time is denied 42 since he has not identified any other specific exhibits which are relevant to exhaustion, and Plaintiff subsequently filed a second motion to submit more exhibits which is granted by the Court. 43 . The Court will consider the relevance of any documents during the Pavey hearing. Plaintiff's motion for Defendants to disclose witnesses and exhibits is denied. 44 However, the Court notes its previous entry concerning Defendants' witnesses was incorrect. See August 9, 2018 Text Order. Defendants have requested a video writ for the following witnesses: Travis Bayler, Heather Cox, and Debbie Knauer. Although a writ was issued for Kimberly Verdun, Defendants have informed the clerk she will not be available to testify. Defendants have not submitted any additional exhibits, so Defendants will be relying on exhibits previously provided in support of the motion for summary judgment.
