- ilcd;;1:17-cv-01335_de20 RegisterActionDescriptionText "TEXT ONLY ORDER entered by Chief Judge James E. Shadid on 12/14/2017. On November 29, 2017, the Court dismissed Plaintiffs initial complaint for failure to state a claim upon which relief could be granted. See November 29, 2017 Merit Review Order. Plaintiffs claims involved allegations of excessive force and problems with heat exhaustion, but he failed to clearly state a constitutional violation. Therefore, he was given time to file an amended complaint. Plaintiff has now filed a motion to inform the Court that one of the Correctional Medical Technicians altered his medication in retaliation for this lawsuit because Plaintiff found a hair in the capsule. 18 This is not an appropriate motion as it is not related to the claims in Plaintiffs previous complaint. If Plaintiff believes the CMT is retaliating against him, he should speak to his counselor and perhaps file a grievance addressing his claim. The motion is denied. 18 (RK, ilcd) (Entered: 12/14/2017)" @default.
