Plaintiff's motion to reconsider merit review order 11 is GRANTED, in part, and DENIED, in part. Plaintiff is correct that the Merit Review Order contains a scrivener's error in that it dismissed Defendant Donelson rather than dismissing Defendant Johnson. Accordingly, that part of Plaintiff's motion is granted, and the Clerk of the Court is directed to re-instate Defendant Donelson and to dismiss Defendant Johnson. The Clerk is further directed to effect service of process upon Defendant Donelson pursuant to the Court's standard procedures. In all other respect, Plaintiff's motion is denied. The Merit Review Order correctly states Plaintiff's legal claim pled therein. Furthermore, Plaintiff may not amend his Complaint via a motion to reconsider. If Plaintiff believes that he possesses additional facts to indicate that the dismissed Defendants were personally involved in the alleged deprivation of his constitutional rights, he may seek leave to file an amended complaint that includes those facts and that does not simply refer to attached exhibits. If he seeks leave to file an amended complaint Plaintiff should attach a complete, proposed amended complaint that, if granted leave to file, will completely replace his original Complaint and will stand on its own without reference to or reliance upon his Original Complaint.
