- ilcd;;1:17-cv-01448_de2 RegisterActionDescriptionText "TEXT ORDER: Plaintiff, who is incarcerated in Taylorville Correctional Center, has filed a letter alleging that he is being denied unspecified medical care, is being harassed by a mental health professional, and was denied the ability to file charges against an unidentified individual who assaulted Plaintiff. Plaintiff asks to be transferred to federal custody, but the Court does not have the authority to do that. A case has been opened to make a record, but whether Plaintiff actually intended to bring a lawsuit is unclear. A prisoner bringing a civil action in federal court is required to either pay the full $400 filing fee or to file a petition to proceed in forma pauperis. If a prisoner is granted leave to proceed in forma pauperis, a reduced filing fee of $350 will be deducted from the prisoners account in installments even if the case is dismissed. 28 U.S.C. § 1915(b)(1). A prisoner must also pursue the available grievance procedures in the prison before filing a lawsuit in federal court, including appealing to the Warden and Administrative Review Board, or the case must be dismissed. Additionally, if a prisoner's lawsuit is dismissed for failure to state a claim, then the prisoner will incur a "strike" under 28 U.S.C. § 1915(g). Accumulation of three strikes bars a prisoner from proceeding in forma pauperis in future cases unless he is in imminent danger of serious physical injury. 28 U.S.C. § 1915(g). The clerk is directed to send the plaintiff a complaint form, an in forma pauperis form, and instructions. By October 31, 2017, Plaintiff must (1) pay the $400 filing fee in full or file a petition to proceed in forma pauperis, and (2) file a complaint naming the individuals who violated Plaintiff's rights and explain how they violated Plaintiff's rights.
