- ilcd;;1:17-cv-01488_de151 RegisterActionDescriptionText "TEXT ORDER entered by Judge Michael M. Mihm on 2/20/2020. Plaintiff files 121 , a motion to compel, asserting that Defendants had not provided him materials requested in his request for production. Plaintiff asserts that this information is needed so that he might respond to Defendants' motion for summary judgment on the issue of exhaustion. Defendants have replied, asserting that they have a pending a Motion to Stay Discovery and that Plaintiff's discovery request should be subject to that stay. Defendants have failed to realize, however, that on January 3, 2020, the Court granted a stay of merits discovery. Here, however, Plaintiff's request to produce appears to go directly to the exhaustion issue and not the merits. 121 is GRANTED as Defendants have 21 days in which to file a response to the outstanding discovery. Plaintiff will have 21 days thereafter in which to file a response to summary judgment. Plaintiff's duplicate motions for extension in which to respond to summary judgment 122 and 123 are rendered MOOT. Plaintiff's 120 , seeking to clarify his requests for an extension of time and his motion to compel is GRANTED to the extent that the Court reviewed the clarification in preparing this order.
