Plaintiff filed two Motions 66 69 seeking trial subpoenas for the witnesses he intends to call during the trial set to begin October 20, 2020. Typically, the Court does not issue subpoenas or writs for the appearance of witnesses until after the parties submit a joint proposed final pretrial order and a final pretrial conference has been held. Often, the Office of the Attorney General will make non-defendant prison officials available for trial without the need for a subpoena. With regard to inmate witnesses, waiting until after the final pretrial conference permits the Court to have a better idea where the inmate will be on the day of trial so that testimony, usually by video, can be arranged. In addition, several witnesses Plaintiff wants to subpoena appear to be outside the Courts subpoena power. See Fed. R. Civ. P. 45(c)(1)(A) (court does not have jurisdiction to subpoena witness who resides more than 100 miles away). Plaintiff should confer with defense counsel two or three months before trial to prepare a joint, proposed final pretrial order that lists the witnesses each party intends to call. Plaintiff's motions 66 69 are denied with leave to renew if necessary after the final pretrial conference. Plaintiff filed a Motion in Limine 67 asking the Court to rule that he is allowed to admit certain evidence. Motions in limine generally seek to exclude evidence prior to trial and should be granted only if it appears the evidence is not admissible in any way. Any finding to exclude or admit evidence at this point is premature. Plaintiff's motion 67 is DENIED with leave to renew within the context of trial.
